Truth in Lending Act (TILA) & APR Disclosures

Under Federal Reserve Regulation Z (12 CFR Part 1026), the Annual Percentage Rate (APR) reflects the true annual cost of credit, including the base note interest rate plus mandatory lender origination charges, discount points, processing fees, and prepaid finance items.

Interest Rate vs. APR: The interest rate determines your monthly Principal & Interest (P&I) payment. The APR is typically higher than the note rate because it amortizes upfront lender fees over the loan duration.

When comparing loans, always evaluate the official Loan Estimate (LE) provided by your lender within three business days of submitting a formal application.

Mortgage Refinancing & Escrow Reserves

Unless explicitly designated in input fields, monthly mortgage calculations reflect only Principal and Interest (P&I). Total monthly housing obligations (PITI) will be higher due to:

  • Real Estate Property Taxes: Assessed by your county and municipal taxing authority.
  • Hazard & Flood Insurance: Homeowners insurance policies required by lenders to protect collateral.
  • Mortgage Insurance: Conventional Private Mortgage Insurance (PMI) on loans with less than 20% equity (LTV > 80%), FHA Annual Mortgage Insurance Premiums (MIP), or USDA Annual Guarantee Fees.
  • HOA / Assessment Dues: Mandatory dues for condominiums and planned unit developments (PUDs).

Escrow Prepaids Notice: Refinancing typically requires establishing a new escrow impound reserve for property taxes and homeowners insurance. While prior escrow balances are refunded by your existing servicer within 30 days of payoff, upfront cash or loan financing may be required at closing.

Your actual eligibility and offered interest rate depend on vehicle age (typically 10 years or newer), mileage (typically under 120,000 miles), and current loan-to-value (LTV) ratio relative to verified NADA or Kelley Blue Book trade-in valuations.

State Department of Motor Vehicles (DMV) title transfer fees, lienholder recording charges, and optional GAP insurance or extended warranties will affect your total financed balance and net savings.
